Welcome to TNT | Trail & Tribe ("TNT," "we," "our," or "us"), a woman-owned, veteran-operated business based in Olympia, Washington, operating through TNTBrand.com (the "Site"). By accessing or using this Site, placing an order, or engaging our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use this Site.
These Terms apply to all visitors, customers, and clients, including those purchasing products, requesting custom work, or contracting us for design and website services.
1. Use of Website
This Site is available for general browsing, but purchases and service agreements may only be entered into by individuals 18 years or older who can form a legally binding contract.
By using this Site, you agree not to:
- Use the Site for any unlawful purpose
- Interfere with or disrupt the security, functionality, or infrastructure of the Site
- Submit false, misleading, or fraudulent information
- Engage in abusive, harmful, or exploitative behavior toward us, our staff, or other users
- Attempt to access areas of the Site not intended for public use
- Use automated systems (bots, scrapers, crawlers) without our written permission
We reserve the right to restrict, suspend, or terminate access at any time, with or without notice, for any violation of these Terms.
2. Products & Services
TNT | Trail & Tribe offers:
- Apparel and merchandise (in-house DTF and heat-press production)
- Print-on-demand and made-to-order products
- Custom-designed items based on customer submissions
- Custom design, branding, and website development services
- Licensed designs and themed collections
Because most items are made-to-order using DTF printing and heat-press methods, products may vary slightly in color, placement, sizing, and appearance. Screen previews, mockups, and digital proofs are representations only. We do not guarantee exact replication of digital previews due to differences in monitors, fabric types, dye lots, and the nature of custom production.
3. Orders & Acceptance
We reserve the right to:
- Refuse or cancel any order at our sole discretion
- Limit or restrict quantities
- Cancel orders suspected of fraud, abuse, or policy violations
Order confirmation does not constitute final acceptance. An order is only accepted once we begin production or fulfillment. If an order is canceled by us after payment, a refund will be issued in accordance with our Refund Policy.
4. Custom Orders, Proofs & Approvals
Custom orders (apparel, merch, or design work) are subject to additional terms:
- A deposit may be required before work begins. Deposits are non-refundable once design or production work has started.
- You are responsible for reviewing and approving all proofs, mockups, and design previews before production.
- Once you approve a proof, you accept the design as-is. We are not responsible for errors (spelling, layout, color, sizing, placement) that were present in an approved proof.
- Changes requested after approval or after production has begun may incur additional charges and delays.
- Custom and personalized items are non-refundable and non-returnable except in cases of our production error or defect, as outlined in our Refund Policy.
We reserve the right to refuse any custom order at our discretion, including orders involving content we deem unlawful, infringing, hateful, or inconsistent with our brand values.
5. Custom Design & Website Services
For clients engaging TNT for design, branding, or website development services, the following applies in addition to any separate written agreement, contract, or statement of work ("SOW"):
- Project scope, deliverables, timelines, and pricing are defined in the applicable SOW or written agreement. Where a signed agreement conflicts with these Terms, the signed agreement controls.
- Deposits and milestone payments are non-refundable once corresponding work has begun.
- Ownership of final deliverables transfers to the client only upon full payment. Until paid in full, all work product remains the property of TNT.
- We may retain and reuse general techniques, code frameworks, and non-client-specific methods for future projects.
- We are not responsible for third-party services the client chooses or controls, including but not limited to hosting providers (e.g., Hostinger), payment processors (e.g., Stripe, PayPal), domain registrars, or plugins and integrations.
- Ongoing maintenance, hosting, updates, and support are not included unless explicitly agreed in writing.
- The client is responsible for the legality, accuracy, and licensing of all content they provide.
- We may display completed work in our portfolio and marketing unless the client requests otherwise in writing.
6. Pricing, Taxes & Errors
All prices are listed in USD unless otherwise stated.
You agree that:
- Applicable sales taxes may be added at checkout based on your location
- You are responsible for any additional charges required by your jurisdiction
We reserve the right to:
- Correct pricing or listing errors
- Update product information and availability
- Cancel orders placed with incorrect pricing
If a pricing error affects your order, we will notify you and either honor the corrected price or cancel and refund the order.
7. International Orders & Customs
Orders shipped outside the United States may be subject to:
- Import duties
- Taxes (including GST/HST in Canada where applicable)
- Customs fees or brokerage charges
These charges are not included in product or shipping prices and are the sole responsibility of the customer.
TNT | Trail & Tribe is not responsible for:
- Customs delays
- Additional charges imposed by customs authorities
- Packages refused or abandoned due to unpaid duties or taxes
Failure to pay required customs fees may result in the package being returned or destroyed. Refunds will not be issued in these cases.
8. Custom Orders & User Content
By submitting any design, file, image, text, or other content, you represent and warrant that:
- You own or have full legal rights and licenses to use the content
- The content does not infringe any intellectual property, trademark, copyright, or publicity rights
- The content is not unlawful, defamatory, hateful, offensive, or harmful
You grant TNT | Trail & Tribe a limited, non-exclusive, non-transferable license to use, reproduce, and modify submitted content solely for the purpose of fulfilling your order.
You are solely responsible for the content you submit. We assume no liability for user-generated materials and may refuse any submission at our discretion. You agree to indemnify us against any claim arising from content you provide.
9. Intellectual Property
All content on this Site — including designs, logos, graphics, text, branding, collections, and code — is the property of TNT | Trail & Tribe unless otherwise stated, and is protected by applicable intellectual property laws.
You may not:
- Copy, reproduce, or distribute any content
- Use our designs for resale or commercial use
- Modify, exploit, or create derivative works without written permission
Unauthorized use may result in legal action.
10. AI-Generated & AI-Assisted Content
Some of our designs and creative assets are produced or assisted using artificial intelligence tools. You acknowledge and agree that:
- The legal status of intellectual property rights in AI-generated content may be uncertain or evolving.
- We make commercially reasonable efforts to ensure our designs are original and non-infringing, but we do not guarantee exclusive copyright protection over AI-assisted works.
- Purchase of a product does not transfer any underlying intellectual property rights unless explicitly stated in a separate written agreement.
11. Themed & Lifestyle Collections
Certain collections feature mature, lifestyle, or culturally themed designs (including cannabis-, parenting-, and humor-themed artwork). These designs are intended as novelty and lifestyle apparel for adults and:
- Do not promote, endorse, or facilitate any illegal activity
- Are sold for personal expression and entertainment purposes
- May not be appropriate for all audiences
By purchasing these items, you confirm you are of legal age and understand the nature of the product.
12. Shipping & Fulfillment
Orders are fulfilled through a combination of in-house production and third-party providers (including Printful and similar partners). Delivery timelines are estimates only and may be affected by production volume, carrier issues, weather, and external factors beyond our control.
We are not liable for shipping delays, loss, or damage once an order has been transferred to the carrier. Full shipping details are governed by our Shipping Policy, incorporated by reference.
13. Returns & Refunds
All returns, exchanges, and refunds are governed by our Refund Policy, incorporated into these Terms by reference. By completing a purchase, you agree to that policy. Custom, personalized, and made-to-order items are generally non-refundable except in cases of our error or defect.
14. Third-Party Services
We use third-party providers including, but not limited to, Stripe, PayPal, Printful, S&S Activewear, and Hostinger. We are not responsible for:
- Service interruptions or downtime
- Errors or failures caused by third-party systems
- Their independent policies, terms, security practices, or actions
Use of third-party services is subject to their respective terms and is at your own risk.
15. Disclaimers & Warranties
The Site and all products and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
16. Limitation of Liability
To the fullest extent permitted by law, TNT | Trail & Tribe shall not be liable for:
- Indirect, incidental, special, punitive, or consequential damages
- Loss of profits, data, goodwill, or business opportunities
- Delays or failures caused by events beyond our reasonable control
Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless TNT | Trail & Tribe, its owners, and affiliates from any claims, damages, liabilities, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Site
- Your violation of these Terms
- Your submitted content or custom designs
- Your violation of any law or third-party right
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, supply chain disruptions, equipment failure, labor shortages, utility or internet outages, war, civil unrest, or governmental action.
19. Dispute Resolution & Arbitration
Please read this section carefully — it affects your legal rights.
Any dispute arising out of or relating to these Terms, the Site, or any product or service shall first be addressed informally by contacting us at Info@TNTBrand.com. We will attempt in good faith to resolve any dispute within thirty (30) days.
If a dispute cannot be resolved informally, you and TNT agree that it shall be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court if it qualifies. Arbitration shall be administered under the rules of a recognized arbitration body and held in or near Olympia, Washington, or conducted remotely where permitted.
You and TNT agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
If any portion of this section is found unenforceable, the remainder shall remain in effect, and any claim that cannot be arbitrated shall be resolved in the state or federal courts located in Washington.
20. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Subject to Section 19, any disputes shall be resolved within this jurisdiction.
21. Order of Precedence
These Terms work together with our Privacy Policy, Refund Policy, Shipping Policy, and Legal Information page, all incorporated by reference. In the event of a conflict between these documents, these Terms control, except where a separately signed client agreement or SOW governs a specific engagement, in which case that signed agreement controls for that engagement.
22. Electronic Communications & Consent
By using the Site or contacting us, you consent to receive communications from us electronically (email, on-site notices). You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that they be in writing.
23. Severability & Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies referenced above, constitute the entire agreement between you and TNT regarding your use of the Site, superseding any prior understandings.
24. Changes to Terms
We reserve the right to update these Terms at any time. Changes take effect when posted with a revised effective date. Continued use of the Site after updates constitutes acceptance of the revised Terms.
